Terms for research-use purchases from Never Enough Labs.

By accessing or using this website (the “Site”) and purchasing our products, you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site or place an order.

1. Overview

Never Enough Labs (“we,” “us,” “our”) supplies research-use-only materials to qualified purchasers. These Terms govern your access to the Site and your purchase and use of our products.

2. Eligibility & Accounts

By using the Site and purchasing, you represent and warrant that you are at least 21 years of age (or the age of majority in your jurisdiction, whichever is greater) and legally able to enter into binding agreements. You agree to provide accurate, current information and to keep your account credentials secure. We may refuse, limit, or cancel orders, and may suspend or terminate accounts, for suspected fraud, misuse, or non-compliance with these Terms.

3. Research Use Only (Critical)

All products are sold strictly for laboratory and research use only, unless expressly stated otherwise in writing. Our products are not drugs, foods, cosmetics, dietary supplements, or medical devices, and are not intended for human or animal consumption, diagnostic use, clinical use, therapeutic use, or any in-vivo use.

You are solely responsible for the appropriate handling, storage, use, and disposal of all products; for following applicable COA and safety-data guidance; and for complying with all applicable laws, regulations, safety standards, and institutional policies. Statements on the Site have not been evaluated by the FDA or any regulatory authority.

4. Ordering, Pricing & Availability

Product listings, prices, and availability may change without notice. We may limit quantities, refuse or cancel orders, or discontinue products at any time. We strive for accuracy, but typographical, pricing, or system errors may occur; where they do, we may cancel or correct the affected order and will notify you. Lot-to-lot variation within normal analytical tolerance may occur. Certificates of Analysis are provided per lot and reflect measured values for that lot.

5. Payments, Taxes & Chargebacks

Payments are processed by trusted third-party payment processors; we do not store full payment card numbers. Prices are shown in U.S. dollars. Applicable sales taxes and fees are added at checkout where required, or are otherwise your responsibility. Suspected payment fraud or misuse of chargebacks may result in account suspension and investigation, and we will contest improper chargebacks.

6. Shipping & Risk of Loss

We aim to ship promptly; delivery times are estimates and may vary by carrier, weather, or holidays. Title and risk of loss pass to you when the carrier accepts the shipment. Please ensure your shipping address is accurate — we are not responsible for delays or losses due to incorrect addresses or carrier issues. We currently ship within the United States only.

7. Inspection & Acceptance

Please inspect shipments upon delivery. Report shipping damage, shortages, or incorrect items within 7 business days of receipt, with photos and your order details. After that window, the order is deemed accepted.

8. Returns & Refunds

Due to the sensitive nature of research products, all sales are final and we cannot accept returns once an order has shipped. If your order arrives damaged, defective, or incorrect, contact us within the inspection window above and we will, at our discretion, provide a replacement or refund for the affected item.

9. Limited Warranty & Disclaimers

We warrant that, at the time of shipment, products will conform to the specifications for the applicable lot. Your exclusive remedy for breach of this warranty is, at our option, replacement of the product or refund of the purchase price for the affected item. Except as expressly stated, products are provided “AS IS” and “AS AVAILABLE,” without warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability & Indemnity

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility. Our total liability for any claim related to a purchase will not exceed the amount you paid for the product giving rise to the claim. You agree to indemnify and hold harmless Never Enough Labs from any claims, losses, or damages arising from your use, handling, or misuse of our products or your breach of these Terms.

11. Intellectual Property

All content on the Site, including logos, text, and images, is owned by or licensed to Never Enough Labs and may not be copied or used without permission.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your information.

13. Changes to These Terms

We may update these Terms from time to time. The current version is always posted here, and your continued use of the Site constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict-of-law principles.
